GENERAL TERMS OF USE OF THE SITE AND SERVICES PROVIDED

Use of the SundaySealed site implies full and complete acceptance of the general terms of use described below. These terms of use may be modified or supplemented at any time, so users of the SundaySealed site are invited to consult them regularly.

 

The site is normally accessible to users at all times. An interruption for technical maintenance may however be decided by EverClever™, who will then endeavour to inform users in advance of the dates and times of the intervention.

 

The SundaySealed site is updated regularly by EverClever™. In the same way, the legal notices may be modified at any time: they are nevertheless binding on the user, who is invited to refer to them as often as possible in order to become acquainted with them.

 

DESCRIPTION OF SERVICES PROVIDED

The purpose of the SundaySealed site is to provide information concerning all of the company’s activities.

 

EverClever™ endeavours to provide information on the SundaySealed site that is as accurate as possible. However, it cannot be held responsible for omissions, inaccuracies and shortcomings in updating, whether caused by it or by the third‑party partners who provide it with this information.

 

All information on the SundaySealed site is given for information purposes only and is subject to change. Furthermore, the information on the SundaySealed site is not exhaustive. It is given subject to changes having been made since it was put online.

 

CONTRACTUAL LIMITATIONS ON TECHNICAL DATA

INTELLECTUAL PROPERTY AND COUNTERFEITING

EverClever™ owns the intellectual property rights or holds the rights of use on all the elements accessible on the site, in particular the texts, images, graphics, logo, icons, sounds and software.

 

Any reproduction, representation, modification, publication or adaptation of all or part of the elements of the site, regardless of the means or process used, is prohibited without the prior written authorisation of EverClever™.

 

Any unauthorised use of the site or of any of the elements it contains will be considered as constituting an infringement and will be prosecuted in accordance with the provisions of articles L.335‑2 et seq. of the French Intellectual Property Code.

 

LIMITATION OF LIABILITY

EverClever™ may not be held liable for direct or indirect damage caused to the user’s equipment when accessing the SundaySealed site, resulting either from the use of equipment that does not meet the specifications indicated in point 4, or from the appearance of a bug or incompatibility.

 

EverClever™ may also not be held liable for indirect damage (such as loss of market or loss of opportunity) resulting from use of the SundaySealed site.

 

Interactive areas (the possibility to ask questions in the contact area) are available to users. EverClever™ reserves the right to delete, without prior notice, any content posted in this area that contravenes the legislation applicable in France, in particular the provisions relating to data protection. Where applicable, EverClever™ also reserves the right to hold the user civilly and/or criminally liable, particularly in the case of messages of a racist, abusive, defamatory or pornographic nature, regardless of the medium used (text, photographs, etc.).

 

MANAGEMENT OF PERSONAL DATA

In France, personal data is protected in particular by law no. 78‑87 of 6 January 1978, law no. 2004‑801 of 6 August 2004, article L. 226‑13 of the Penal Code and the European Directive of 24 October 1995.

 

When using the SundaySealed site, the following may be collected: the URL of the links through which the user accessed the SundaySealed site, the user’s access provider, the user’s Internet protocol (IP) address.

 

In any event, EverClever™ only collects personal information relating to the user for the needs of certain services offered by the SundaySealed site. The user provides this information with full knowledge of the facts, in particular when he or she enters it personally. The user of the SundaySealed site is then informed whether or not it is mandatory to provide this information.

 

In accordance with the provisions of articles 38 et seq. of law 78‑17 of 6 January 1978 relating to data processing, files and freedoms, every user has the right to access, rectify and oppose personal data concerning him or her, by sending a written and signed request, accompanied by a copy of an identity document bearing the signature of the holder of the document, specifying the address to which the reply should be sent.

 

No personal information of the user of the SundaySealed site is published without the user’s knowledge, nor exchanged, transferred, assigned or sold on any medium whatsoever to third parties. Only the assumption of the purchase of EverClever™ and its rights would allow the transmission of said information to the eventual purchaser who would in turn be bound by the same obligation to store and modify data with respect to the user of the SundaySealed site.

 

The aforementioned site is declared to the CNIL under the number “En cours d’attribution” (pending assignment).

 

The databases are protected by the provisions of the law of 1 July 1998 transposing Directive 96/9 of 11 March 1996 on the legal protection of databases.

 

HYPERTEXT LINKS AND COOKIES

The SundaySealed site contains a certain number of hypertext links to other sites, set up with the authorisation of EverClever™. However, EverClever™ is not able to verify the content of the sites thus visited, and will therefore not assume any responsibility in this respect.

 

Browsing the SundaySealed site may result in the installation of cookie(s) on the user’s computer. A cookie is a small file which does not allow the user to be identified, but which records information relating to a computer’s browsing on a site. The data obtained in this way is intended to facilitate subsequent browsing on the site and is also intended to enable various visitor statistics to be compiled.

APPLICABLE LAW AND JURISDICTION

Any dispute in connection with the use of the SundaySealed site is subject to French law. Exclusive jurisdiction is given to the competent courts of Paris.
